KLANG Municipal Council (MPK) president Datuk Mohamad Yasid Bidin agrees that the stadium is in a bad shape but they do not have the funds for its repairs.

“We submitted an application to the Selangor State Economic Planning Unit for a budget to refurbish as well as rebuild certain sections of the stadium,” he said.

He said MPK had put up signboards at the stadium to warn users that they were using the facilities at their own risk.

He added that the signage was to protect the council from law suits.

“People are warned of the risk when they enter the stadium to exercise,” said Mohamad Yasid.

“Having such a notice would suffice as the risk warning need not be specific to any particular risk, but we cannot stop people from initiating legal suits,” he said.

However, lawyer Gerard Lazarus said the notice boards were “provocative.”

“Sports facilities must be in good condition.

“Putting up these signboards in red as a disclaimer against injuries sustained by people due to bad upkeep of sports facilities, does not absolve the local council’s responsibilities,” he noted.

He questioned if MPK was acknowledging the fact that the facilities were in a horrendous state and that any injury to a person while in the stadium would be the fault of the injured.

“I suggest MPK totally shut down the stadium as it is a hazard to users,” he added.

Lazarus said the running track was worn out and joggers faced the possibility of injury, especially if they fell.

“The exclusion clause in the notice will not totally protect MPK as any injury or loss of life is not an exclusion under the law.

“MPK is only protected if the danger or hazard is notified specifically. In this case, the notice is very general.

“I hope the council will look into this issue seriously,” he added.
